Effective Date: November 12, 2025
Last Updated: November 12, 2025

1. Introduction
Welcome to The Memory Collective (“TMC,” “we,” “us,” or “our”). Your privacy matters to us. This Privacy Policy explains how we collect, use, and protect your personal information when you visit our website (www.thememorycollective.co) or use any of our related products and services (collectively, the “Services”).
By using our Website or Services, you consent to the practices described in this Policy.

2. Information We Collect
Personal Information: includes your name, email, address, phone number, payment details, and any other information you voluntarily provide. It also includes story data—audio, video, photo, or text materials you upload, record, or store within your TMC account.
Non-Personal Information: includes your IP address, browser type, device data, and browsing activity, collected automatically to help us improve performance and usability.

3. How We Use Information
We use your information to:
   • Create and manage accounts
   • Provide and improve our Services
   • Communicate about your account or purchases
   • Send optional newsletters or updates
   • Provide support or fulfill service requests
Story data may be accessed only when necessary (for example, during a professional 1-on-1 project or technical issue) and only by authorized TMC team members.

4. Cookies and Tracking
We use cookies and similar technologies to personalize your experience and analyze website traffic. You can manage cookies through browser settings, though disabling them may limit functionality.

5. Third-Party Services
We use trusted providers for hosting, analytics, and payments (such as Stripe, MailerLite, and Zoom). These partners process data on our behalf under confidentiality agreements. We are not responsible for their independent privacy or security practices.
Access to user data is limited to authorized TMC personnel and contractors bound by confidentiality obligations.

6. Data Sharing
We never sell or rent your information. We share data only when necessary to provide Services, comply with legal requests, or protect rights and safety.

7. Data Security
We maintain reasonable security measures to safeguard your data. However, no online platform is completely secure. By using our Services, you accept these inherent risks.

8. Health Information and HIPAA Disclaimer
TMC is not HIPAA-certified and does not offer special protections for health data. If you choose to include health-related information in your projects, you do so voluntarily and at your discretion.

9. Data Retention and Deletion
We retain your data as long as your account is active. If canceled, your data may be permanently deleted after a grace period.
TMC currently does not offer an automatic data export feature. Please save any materials you wish to keep before closing your account.

Access Following a Client’s Death
In the event of a verified death, TMC may review limited portions of the deceased client’s account to confirm beneficiary identities and deliver stored materials in accordance with the client’s recorded preferences. Such access is logged and restricted to authorized personnel only.

10. Disclosure of Criminal or Harmful Acts (1-on-1 Services Only)
In rare cases, information shared during a professional 1-on-1 project may reveal serious crimes or threats of harm. If we reasonably believe a person is in danger or disclosure is required by law, we may report that information to law enforcement or appropriate authorities.
This clause applies only to direct 1-on-1 services where TMC personnel are actively engaged with client content.

11. International Users
Our Services are operated in the United States. By using them from another country, you consent to your information being processed and stored in the U.S.

12. Children’s Privacy
Our Website and Services are not intended for unsupervised use by children under 18. We do not knowingly allow minors to create accounts or submit personal information without parental or guardian consent.
Parents and guardians may include information about their children or record stories with their children as part of family storytelling projects. In those cases, the parent or guardian is fully responsible for managing that content and its distribution.
If we discover that a child has created an account or submitted personal data directly, we will delete it promptly.

13. Your Privacy Choices
You can:
   • Opt out of marketing emails at any time
   • Update or correct your account details
   • Request deletion of your data by contacting us (subject to legal limits)

14. Changes to This Policy
